Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a binding legal agreement between you and MedCost Data LLC d/b/a Brainy Bee ("BrainyBee," "we," "us," or "our"). By creating an account, uploading content, or using our services, you agree to be bound by these Terms. If you do not agree, you must cease use of the service immediately.

2. User Accounts & Eligibility

You must be at least 13 years of age to use BrainyBee. You are responsible for maintaining the security of your account (authenticated via Google Sign-In) and for all activities that occur under your account.

4. User Content & Intellectual Property

• Your Content: You retain ownership of any coursework or materials you upload to BrainyBee. By uploading, you grant us a limited license to process this data solely to provide the service to you.
• AI Output: Subject to your compliance with these terms, we assign to you all rights, title, and interest in the output generated by the AI based on your input.
• Prohibited Content: You may not upload content that infringes on third-party intellectual property or contains illegal materials.

5. Billing and Credits

BrainyBee operates on a pay-as-you-go basis. To access AI-generated workflows, you must purchase Credits. These credits are billed at the time of purchase and are deducted from your account balance as you use the services.

• Refunds: All Credit purchases are final. Unless required by applicable law, payments for Credits are non-refundable and non-transferable. Unused credits cannot be redeemed for cash.
• Tax/Expensing: It is your responsibility to provide the correct billing name (Individual vs. Company) for your receipts to ensure accurate tax reporting.

6. Limitation of Liability

BrainyBee is provided "as is." We shall not be liable for any academic failure, loss of data, or damages resulting from your reliance on AI-generated content. Our total liability is limited to the amount you paid us in the past 12 months.

7. DMCA Copyright Policy

BrainyBee respects the intellectual property rights of others. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond expeditiously to claims of copyright infringement committed using our service.

If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement that is taking place through BrainyBee (e.g., in a shared "Hive" or uploaded document), please submit a notice containing the following information to our Designated Copyright Agent:

• Ideally, specific identification of the location (URL) of the infringing material.
• A description of the copyrighted work that you claim has been infringed.
• Your contact information (email, address, phone number).
• A statement that you have a "good faith belief" that the use is not authorized.
• A statement that the information is accurate and made under penalty of perjury.

8. Governing Law

These terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
